Default Question for all mechanics

I am having a problem with my neighbour. He works on cars till early hours of the morning, fills the street up with cars and is making it impossible for us to move. I am just curious, do you need a lisence to have your own garage or not. If so is there a commision that deals with these matters which i can approach to get this guy to stop. Everyone has enough of seeing s*@t boxes driving like crazy up and down the street.

Thanks
Bill

I think he is entitled to work on cars, but must not cause noise after ceratin hours or before certain hours.

He probably has to keep the place clean and safe.

If he is earning money from his back yarders, he must declare it as wages.

Different councils have different rules for this sort of stuff

If he's doing backyarders the ATO will want to know about it. You can't legally work on a car in the street. Otherwise, there's nothing to say you can't work on cars at home. Of course there are noise restrictions and what not.

At best guess it would have to be local council that you should contact and ask best options etc, and also maybe a call to the police whilst he has cars there or is working on them late at night (or early in the morning).

But, have you (or any other neighbours) spoken to this person to state the noise is irritating etc. Maybe that is the first option......

By the way, I forgot to add one of the neighbours went to the council, and said they didnt give a rats *** about what was happening. Cops from what I understand are investigating him. We have talked to him. We tolled him we don't like how his dog s*@ts in our backyard and asked him to clean it and doesn't do it. You ask him to move the cars and doesn't care.

I can't wait for the night for someone to come around the corner like a nutcase, (as it happens often) and takes out a couple of his cars. His dog is going to get run over also because its always running around in the middle of the street.

Were going to contact the previous owners to see if they can do anyhting. We knew them for 20 years. When the wife passed away, the husband had two strokes and now is in a nursing home. We went from the best neighbour you could possibly ask for, to a bunch of pigs.

Bill.

Well you do have a painful situation... Is he renting or has it bought the place?
If this person is renting you can force the council into taking action by all neighbours concerned signing a petition (this can get nasty though) and reminding them of how many there are of you for next election time!!!

About the dog though, ring the pound... it would be horrible for an innocent dog to be killed or injured through a lazy pig of an owner, its not the dogs fault he hasnt been trained properly or isnt kept in his own yard.

I am sort of gathering you may be in a smallish area, if so, there would have to be a local member of parliament that 'might' be more interested in the situation than local council....

I got my dad to give the owner of the house a call, but no answer. Well it is also a weekened. I've told may dad to make them aware of what is happening and what they have done to the street, and hopefully when the lease is up, we will get new tenants. I think the children who are renting it will listen, as our families, were very close before the husband was put into a nursing home.

Why can't they be just normal people. I wouldn't be surprised if they were filming porn in their garage. Everyone believes they are and it quite revolting.

A standard clause in alot of rental agreements is you can't carry out major car repairs at least that's what I have pretty much had in all 3 of mine IIRC. My current one says
"The tenant agrees not to carry out any mechanical repairs or spray painting of any motor vehicles, boats or motor cycles in or around the property including common property."
Then there's other clauses about the use of premises - one being not using premises in such a manner as to cause a nuisance or or cause an interference with the reasonable peace, comfort or privacy of any occupier of neighbouring premises.

These would be typical clauses - the one about not doing repairs is so the owner doesn't look in the garage during an inspection to find the concrete covered in oil or auto spray paint on the walls. If they are renting through an agent, the tenant could very well have clauses such as these in their lease. Once you get on to the owner, he may have a lease which stipulates these type clauses.

So if they have breached one of these clauses, does that mean they can be given the boot?

Report him to the ATO, say he is doing cash jobs and that he might be breaching the system. If he is being a pr!ck, then stuff him up.

What he is dooing is totaly illegal !!!! The peaple to contact is the M.V.R.I.C ( motor vehicle repair industry council. They would be keen to find out what this guy is dooing and there is BIG fines involved if found guilty. To be working from his back yard, he has to be a licenced mechanic with a FULLY LICENCED premisis aproved by the M.V.R.I.C and the local council ( which i doubt he has when he is working from his backyard ). This subject gets me a little angry as i am a fully licenced motor mechanic...and i cant stand these "backyard butchers" that think they know it all and get away with working on other peoples cars with NO INSURANCE for your car or even worse...YOUR OWN LIABILITY. :

The son is a realestate agent, so he does all the work himself, when it comes to renting the house. I'm going to give the son a buzz tomorrow night and fill him in with the details.

Thanks very much thunderoo. I will be getting to MVRIC asap, as this guy blocks our driveway. There are also instances where my dad comes home from work at 9.00pm, and has had to park on the other end of the street because he has all these cars that are ment to be going to his joint.

Thankyou all for your help.

You cant run a business like that from a residential property, it has to be in a correctly zoned area. Report it to the council in a formal letter, and/or bring it up at a council meeting.

You should remind the council that they can impose a nice $$ penalty and tow his car away if it is illegally parked. While councils have a reputation for being lazy, if there's a possibility of a fine being imposed, they're usually tripping over themselves to act.

Varies from state to state, but typically, they are given a period of time to rectify the situation and are ony given the boot if they fail to do so.

I have found from personal experiance that the council will act rather quickly on vehicles being parked illeagaly.
I had them come out to my place about 10 times over my truck being parked in the street. (It was parked legaly).
They advised me on the local parking laws and advised me just to be careful as some body keeps dobbing you in.

they also said that if it was on there board and they had not acted that they then had to explain why they had not addressed this complaint.

gee's mate i wish i had your council,
here in Hervey Bay QLD the council wont let me even work on one car as the old ***** next door rings them and the police everytime i try and do more than an hours work on my car,the laws in QLD say anyone can paint there car in the driveway (not one a week)as long as its your own,but one complaint from neighbour like the A&SE H&le
i have next door and the council are all over you like a rash.which means im the only person in my street who cant use a hammer ,spraygun or spanner ,yet i only had one argument with him last year when i sprayed some undercoat on repair so after that i would wait for him to go out before doing any work as he siad the fumes ruined his peace and tranqulity which council backed him 100% on as they started coming here at least once a week for not mowing lawn causing rats to infest next door(grass has never been over 5inches high)then too many cars on property so i must be running a workshop(4 cars)one of which is my daughters car,as it sounds like you have someone who is actually doing bad things ,do what my neigbour has done and ring council and exagerate (you wont need to) as he is real bad by the sounds of it
Oh yeah i forgot the worst ones
Fair Trading god they are the worst ,will hassle him like mad.

This gets me angry. I have worked from home for over 15years in Melbourne. I have all of the correct permits and qualifications and never had any complaints from any of my neighbour. Yes it sounds like you have the neighbour from hell but i don't think Thunderoo has the right to lump us all in the same basket.

If you have the correct "licenced" premisis and you are a "licenced" motor repairer....there is no problem ??? The thing that blows my fuse is the guys that are on centerlink payments and goverment housing...and then doing "backyard repairs" when ive had to go to school...get good grades...find an aprenticeship...do my 3 years of tech ( and pass ) and then my an extra year...then mind you on s$#t wages, then work my *** off to get where i am now ( workshop manager ) for one of the largest workshops / gas installers on the mid north coast of NSW. And all these other guys just open there backyard fence and say ....come on in ...ill fix your car for half the price....not sure if it will be done right....and i dont have to pay thousands of dollars of insurance and spend thousands of dollars every year for occupational health and saftey, let alone have to meet the requirements of the motor repair industry council....the roads and traffic authority....the enviromental protection agency...and the local council....and to top all those of to meet all the saftey requirements of the ocupational health and saftey !! I dont hold gruges against guys who work on there own cars at home...every body does it !! Its the guys mentioned at the start of this link that bring in every sort of cars..... working for cash...on unlicenced and uninsured propertys and causing problems for there neighbours.

Mate, I normally wouldn't because it's pretty low to dob someone in without trying to talk it through first, but this guy seems like a lost cause. Get MVRIC, the ATO and the EPA onto his ****. I'll bet a month's wages this guy isn't getting rid of used oils and such in the correct manor. The EPA love that.

The collecyion of burnout marks had stopped. Then him and his mates came along and started it up again. Its so annoying hearing them ripping burnouts at 2am. I don't see them, but I know its them because i can here the cars l;eaving from his garage. I've had a fight with his partner because i was supposably too close to their driveway when there was more than enough room. Then there friend one day parked right in the centre of my driveway path it was all good. C*@p like this and packets of cigarettes and bear bottles thrown in my front lawn, and dog s*@t all over my property is a just reason when they have been kindfully asked not do stuff like that. I have never said anything to them about the cars. They are inconsiderate pigs who deserve to cop it hard for the way they treat others. Might teach them respect others space and property.
